Posted by Yehuda Berlinger as Card Games
In South Carolina, all games with cards or dice, from poker to Monopoly, are essentially illegal. That includes private games played in your living room. Last February, the law was changed to allow a few games to be played as fundraisers within churches.
The police really go around arresting people if they hear about games being played for money, whether for betting or through buy-ins. Five such guys have been fighting a 2006 arrest for playing poker and their lawyer is now arguing that poker, while involving luck, is a game of skill, and should be exempt from any gambling laws.
This is the first time, to my knowledge, that the definition of poker is going to court.

Actually this argument has been around for a while. According to the ABA Journal: from last year: “In a 1989 case, a California judge held the game was one of skill and allowed card rooms to continue operating. Other judges have disagreed.”
